Terms of Service

1. Who we are

Regatta Connect is operated by Merwin Software, LLC ("Regatta Connect", "we", "us"). Regatta Connect is a marketplace that lets boat owners ("Owners") list rowing shells for rent at specific regattas and lets rowers, coaches and clubs ("Renters") request and pay for those rentals. By creating an account or using the site you agree to these terms, our Privacy Policy and our Refund Policy.

2. Our role

Regatta Connect provides the listing, booking, scheduling and payment tools. We are not a party to the rental agreement itself: the rental is between the Owner and the Renter. We do not own, inspect, insure or deliver any boat, and we do not guarantee the condition, suitability or availability of a boat beyond what the Owner has listed.

3. Accounts and verification

You must be at least 18 years old and provide accurate information. You are responsible for activity under your account and for keeping your password secure. Before listing or renting a boat we require email, phone and government-ID verification (handled by Stripe Identity). Owners also need a connected Stripe payout account before they can accept a rental. Organizations may add members who can then act on the organization's behalf; organizations are responsible for the actions of their members.

4. Listings

Owners set the rental price, the events the boat is available for, hot-seat rules, rigging and oar availability. Owners must have the right to rent the boat, keep the listing accurate, and honour accepted rentals. Photos must follow our photo guidelines; we may remove photos or listings that do not.

5. Requests, acceptance and payment

A Renter requests a boat for one or more events using a saved payment card. Nothing is charged at request time. When the Owner accepts, the Renter's card is charged the listed price for each accepted event. Payments are processed by Stripe and sent directly to the Owner's connected account; Regatta Connect retains a 10% service fee from each rental. Regatta Connect does not hold rental funds. Accepted rentals block the boat for those events so it cannot be double-booked.

6. Cancellations and refunds

Renters may withdraw a request before it is accepted. Owners may cancel an accepted rental up to the start of the regatta, in which case the Renter receives a full refund. Accepted rentals are otherwise non-refundable through the platform. Full details are in the Refund Policy, which forms part of these terms.

7. Using the boat

Renters must use the boat only for the accepted events, follow the Owner's reasonable instructions and the regatta's rules, and return it in the condition received. Renters are responsible for damage or loss caused during their use, and Owners are responsible for providing a boat that is safe and as described. Owners and Renters are encouraged to agree on insurance, rigging and hand-over arrangements directly; Regatta Connect shares each party's contact details before the regatta for this purpose.

8. Acceptable use

Do not use Regatta Connect to arrange rentals outside the platform to avoid fees, post false or misleading information, harass other users, scrape the site, or interfere with its operation. We may suspend or close accounts that break these terms.

9. Fees and taxes

Our service fee is shown to Owners before they list. Owners are responsible for any taxes on their rental income. Prices are in US dollars.

10. Disclaimers and liability

The platform is provided "as is". To the fullest extent permitted by law, Regatta Connect is not liable for damage to boats or equipment, personal injury, regatta changes or cancellations, or indirect or consequential losses arising from a rental. Our total liability to you for any claim relating to the platform is limited to the service fees we received from the rental concerned.

11. Disputes

Owners and Renters should first try to resolve issues between themselves. If that fails, contact us within 7 days of the regatta and we will review the booking with both parties. These terms are governed by the laws of the United States and the state in which Merwin Software, LLC is organized.

12. Changes

We may update these terms as the platform evolves. Material changes will be announced on the site or by email; continued use after a change means you accept the new terms.
